Terms, Conditions and Cancellation Policy

Please carefully read our General Booking, Cancellation, Payment and other Terms which apply to all bookings with Dive Funatics

1. Definitions

1.1 Dive Funatics and Lifestyle Funatics Group Inc. shall be construed to comprise “the Company”, as well as all their affiliates, officers, agents, employees, workers, directors and representatives.

2. General Booking

2.1 All customers must show proof of diving certification from either PADI, SSI, CMAS, or equivalent certifying organizations if taking part in any non-entry level diving activity.

2.2 All customers must complete and sign the relevant Liability Release and Assumption of Risk Form before commencing in-water activities.

2.3 The Company is not permitted to dispense any medical advice. If you are unsure of a medical matter related to diving or otherwise, please seek advice from a certified Medical Practitioner before engaging in scuba diving or similar activities.

2.4 Upon signing up for any diving course, irrespective of previous experience or training, the Company requires each student to complete a Medical Questionnaire.

2.5 The maximum depth permitted on all Company vessels is 30 meters for Open Water Divers with the Deep Adventure Dive certification, Advanced Divers, Rescue Divers, Divemasters and Instructors. Open Water Divers without any additional Deep training will not be permitted to dive deeper than 18 meters. If a diver has received prior Deep Dive training then the absolute maximum depth permitted is 40 meters.

2.6 The Company reserves the right to modify and/or cancel diving arrangements for the reasons listed, but not limited to, those below:

2.6.1 the number of customers scheduled for the trip;

2.6.2 weather conditions making the trip to the scheduled destination not possible;

2.6.3 other ensuing technical difficulties.

2.7 Unless the dive location and trip destination is specifically agreed upon, by default, all training dives and fun dives are conducted in the house reef of Kontiki Mactan; while boat dive destinations by default are in and around Mactan.

2.8 Customers or students who fail to participate in any dives on a trip, or any course training dives, for whatever reason, shall not be reimbursed by the Company for any unused or uncompleted portion(s) of the trip or course.

3. Insurance

3.1 Customers are strongly advised to secure appropriate travel insurance, with a reputable insurance provider, and applicable to the activities they will be undertaking. Such insurance should provide comprehensive coverage of at least the following; Diving, Medical, Travel, Personal Liability and Cancellation provisions. The Company shall not be held responsible for any resultant financial or personal loss or injury where customers choose not to secure such insurance.

3.2 The Company shall not accept any liability for the loss or damage of any luggage or dive equipment whilst on board the boat, nor during the transfer(s) to or from the boat.

4. Price and Payment

4.1 A 5 % fee shall be applicable for all payments via credit card (VISA or Master Card) and via Paypal.

4.2 The number of dives in any package is an estimate based on usual diving circumstances, and not a guarantee. Where circumstances arise, such as, but not limited to; adverse weather conditions, personal illness, technical difficulties, dive site remoteness/inaccessability or personal choice, and cause a reduction in this estimated number, there will be no partial refund in such circumstances.

5. Customer’s Obligation

5.1 Where the customer is negligent or irresponsible, and causes any damage to, or loss of property and equipment belonging to the Company, the customer shall recompense the Company in full, to the current market value of any loss or damage.

5.2 The customer undertakes to be physically, emotionally and mentally prepared and fit to participate in the activities they have signed up for. Any resultant injury or discomfort borne out of any unfitness shall not provide any ground for complaint or refund.

5.3 The customer undertakes sole responsibility for ensuring that required travel documents are in order and valid before booking your dive trip or course with us.

5.4 The customer agrees that instructor assignments will be the sole discretion of the Company. This is to ensure that internal matrix, course loads, and other considerations are properly controlled and followed, as the Company sees fit. Under no circumstances can the customer dictate who will run the courses.

5.5 The Company represented by any of its Instructors, may prohibit an individual’s participation on a dive(s), where they are physically, mentally or emotionally unfit to dive, demonstrate a distinct lack of respect for or handle/harm marine life, consume alcohol between dives, or fail to abide by general international safe diving standards and practices.

6. Deposits

6.1 Deposits are required to cover costs incurred for allocating course manuals, materials, accommodation arrangement, boats, transportation, and other resources, etc as they apply to a particular trip or course bookings.

6.2 For all PADI Non-professional courses – A 50% deposit must be paid before the booking can be fully confirmed. For the Discover Scuba Diving experience a 2,500 PHP deposit per person is required to secure the booking.

6.3 Once the booking is confirmed by receipt of a deposit, the deposit is non-refundable in the event of any cancellation.

7. Rescheduling / Rebooking

7.1 The Company is committed to low training ratios and does not over-book its classes. Our commitment to the highest level of quality training and safety is our number one goal. When you schedule a class, confined, or open water training session, you are prohibiting another customer from booking or reserving that spot. Once you schedule your class, confined, and/or open water training sessions, you may reschedule your training sessions as long as you notify us a week before your scheduled booking with no additional penalties. Any and every change in schedules made after the 1 week window shall be subject to $50 USD rescheduling / rebooking fee provided that the notification of such change is done not later than 24 hours before the commencement of the booking date, otherwise, the booking is deemed cancelled by the customer.

7.2 Rescheduling or rebooking is only permitted within six (6) months from the initial booking date.

8. Cancellation

8.1 The Company will refund all monies paid by the customer where the Company itself cancels a trip or course for reasons NOT stated above. The refund will not include the cost of any PADI materials provided to the customer. The PADI materials may be retained by the customer for future use. In the case of a refund, bank transfer fees will be deducted from the refund.

8.2 If a customer requires emergency evacuation and the boat must return to land, the Company shall not accept any financial responsibility for any ensuing itinerary changes.

8.3 Scuba Diver course – students who cancel before  midday of day 1 will be charged 80% of course costs.

8.4 Open Water course – students who cancel while still training on day 1 will be charged 50% of course costs. Should the student decide to discontinue the course at the end of all training modules in day 1, he/she will be charged 80% of course costs. Any cancellation made on day 2 will be liable for full payment.

8.5 Continuing education courses – students who cancel during day 1 will be liable for 70% of course costs and full payment will be required for cancellation any time after day 1. This applies for courses which require more than a day to complete. For courses designed to be completed in a day, any cancellation will be liable for full payment.

8.6 The outstanding balance for all courses or tours booked must be paid in full to the Company before the time the trip or course is due to commence. The outstanding amount will also be non-refundable where a cancellation is made less than 24 hours before the time the trip is due to depart, or the customer is a no-show on the day.

9. Remedial Training

9.1 If you do not meet the minimum requirements for earning certification or completing a portion of your training to move forward to certification, you may choose to extend your training days and conduct remedial sessions to satisfactorily fulfill all performance requirements for the course. The cost of remedial training per day is $ 75 USD, excluding the rental of specialized equipment listed, but not limited to underwater camera, strobes, oxygen analyzers, etc.

10. Free Shared Accommodation

10.1 Free accommodation is provided in some courses. The company solely has the right, at its discretion, provide suitable accommodation for its students on a sharing arrangement. The room(s) provided are generally for sharing with other students.

10.2 The customer(s) undertakes full responsibility for keeping their belongings, documents, and valuables secured.

10.3 You agree to waive all claims against the Company for any injuries, damages, losses or claims, whether known and unknown, which arise during or result of your  acceptance and availment of the shared accommodation provided by the Company, regardless of whether or not caused in whole or part by the negligence or other fault of the Company.

11. Third Party Provider

11.1 Dive Funatics mainly provides PADI Scuba Diving Training as its core service. As such, we work closely with third party providers to support its non-core services such as guesthouses and hotels to provide its bundled accommodation, as well as for its transportation, boats, air filling and equipment supplies from its accredited suppliers.

12. Governing Law

12.1 This contract shall be governed by, construed, and enforced in accordance with the laws of the Republic of the Philippines.

I HAVE FULLY INFORMED MYSELF AND MY HEIRS OF THE CONTENTS OF THIS TERMS, CONDITIONS AND CANCELLATION POLICY BY READING ALL STIPULATIONS HEREIN BEFORE BOOKING THE SERVICES WITH DIVE FUNATICS ON BEHALF OF MYSELF AND MY HEIRS.
